Court stops Anambra community exco from electing monarch

A vacation High court sitting in Awka, Anambra State capital, Presided over by Hon. Justice Tagbo Anieto, has stopped the caretaker committee members of Oba community, Idemili South Local Government Area, from electing the traditional ruler of the community pending the determination of the substantive suit before it. 

In the suit No. HID/219/2023 and motion No. HID/755M/2023, the plaintiff, Mr. Lawrence Mgbeafulukwe, dragged to court, Sir Osita Ubadi and Hon. Barr. Chuba Oranusi, for themselves and the caretaker committee, (defendants).

Among the reliefs the plaintiff prayed the court to grant him included, an order of interlocutory injunction restraining the defendants/respondents, their privies, agents, committee or by what ever name called, from electing/appointing and/or presenting to the Anambra State Government, through the Hon. Commissioner, Ministry of Local Government, Chieftain and Community Affairs, Anambra State, the name or person of Chief Okwuduba Anyaora, (Ijele Oba), or any person as the traditional ruler of Oba or taking any step or further steps or actions towards the appointment, selection or election of any person pending the determination of the substantive suit.

The judge had upon hearing the submissions of P.U.P. Onuora, counsel to the plaintiff, and after due consideration of 25 paragraph affidavit of urgency, in support, swore to by Mr. Lawrence Mgbeafulukwe, made his order in favour of the plaintiff.

The orders included that the plaintiff's prayer was granted and that the suit be transmitted to the Administrative Judge of the Ogidi Judicial Division for assignment of the suit to a court after the annual vacation.

He added that the motion was granted pending the determination of the substantive suit.
